A MEETING OF MINDS?
Worden is a medium-sized industrial town in the Midlands. It grew up around the local electronics plant, which is part of a large international group that makes and supplies electrical components to the automotive industry. The economic fortunes of the town have consequently tended to fluctuate with the fortunes of the plant, and therefore, the automotive industry. The last decade has however been a relatively stable period for the town and it is thought that there will not be a change to the low rate of economic growth in the area.

The electronics manufacturer is the major employer in the area. Also in Worden there is a reasonable amount of industry and commerce comprising mainly of small engineering works and the necessary industrial, commercial and retail services. There are also a number of large farms on the outskirts of the town.

There are two accountancy partnerships in the town. They provide accounting, audit, taxation and, when necessary, consultancy services to a range of customers in the town. However, the electronics manufacturer uses one of the big international accounting firms.

Mann and Mann is the older of the two practices. It was founded by the father and uncle of the current Senior Partner. Its clients include all of the local farmers along with a mixture of the other businesses in the town. It is located in the centre of the town in very spacious accommodation that it owns. This part of town is also the site of many of the town’s solicitors and other professional offices

Parker and Hall is the relative newcomer. Parker founded the practice fifteen years ago. Having previously been involved with the large firm of auditors who audited the electronics plant and on leaving that firm had decided to start his own practice in Worden. Parker and Hall currently rent premises in the business park on the outskirts of the…...

Scenarios

...Scenario 1 The VP of Operations has assigned me and my team to come up with a strategy of initiating this new beverage into the global marketplace and provide feedback of our strategic marketing plan back to him; resulting in downward communication commonly used within many corporations amongst upper and middle managers but “the best communicators explain the reasons behind their downward communications but also solicit communication from the employees they supervise.” (Robbins & Judge, 2011, p. 345) The communication channel I will use is texting due to the fact we need to come up with a strategy and implement it within a week; I would need to get everyone together ASAP; I think of texting as emailing but on a fly and when I’m in a hurry. To the conference room we go. While we are meeting I will be using the lateral form of oral communication because we are peers in the same group; yes I may be the leader; but my contributions are no more or less than anyone on this team. This presentation will be a part of the upward communication channel once we (the group) have successfully decided on how to implement this strategic marketing plan. In order to effectively engage the Vice President of Operations; we must have our boss’ undivided attention, explain what we believe would work the best and make sure that our agenda utilizes the boss’ attention quite well. The lateral communication channel is the best choice in this situation because our boss will have the feedback that he...

...is. At times that tort law includes the protective barrier over criminals, and in many cases it is used as exactly that. This paper examines the lives of varied individual in four different cases in which tort law is used, and quite possibly abused. The Scenario Paper In any courtroom across the country, and more than likely, across the globe, a person can find the use of tort. Over the years, the governing bodies in tort law have transformed it from its common law origins. Tort, as with any law, is forever changing and evolving by the use of lawyers and judges, alike. Despite certain efforts for the reform of tort, it is still difficult to overlook the use of modern torts and fail to see the convoluted system of rules and laws covering the main purpose of tort law. According to the Cornell University Law School website (2010, para. 4), “torts fall into three general categories: intentional torts (e.g., intentionally hitting a person); negligent torts (e.g., causing an accident by failing to obey traffic rules); and strict liability torts (e.g., liability for making and selling defective products).” This paper will examine a few of these types of torts and their possible outcomes. Scenario One In scenario one, there are several intentional and unintentional tort actions that are displayed. The torts that clearly stand out are battery and intentional infliction of emotional distress. Actional battery existed when Daniel came into physical contact with Malik......

Analysis of Understanding the Mourning Process by J. William Worden

...Chapter 2 Understanding the Mourning Process J. William Worden developed a concept he called the “Tasks of Mourning” to help with the understanding of the mourning process for clinicians. Following is a breakdown of those four tasks: 1) To Accept the Reality of Loss – After a death, the survivor always has a sense of denial, that it really hasn’t happened. This comes in the form of searching behavior, misidentifying the deceased in the living, and having to remind themselves that the deceased is really dead. When people get stuck in refusing to believe the person has died, they are in denial. Denial can take several forms such as facts of the loss, meaning of the loss, or irreversibility of the loss. Also used in denial is the use of spiritualism – searching for a reunion with the dead by attending séances or spiritualist churches. Since acceptance of their loss is intellectual as well as emotional, it takes time. Traditional rituals (such as a funeral) can help the survivors with acceptance of their loss. This is harder for individuals not able to be present for the death and/or unable to attend their funeral. 2) To Work Through the Pain of Grief – Everyone feels some level of pain after experiencing a loss, and not everyone experiences the same level of pain. In order to not feel the pain, people will do and respond in different ways. They may try to cut off their feelings by denying the pain, use thought-stopping procedures, idealizing the dead, and......

...Legal Risk and Opportunity in Employment (New Corp Scenarios) LAW/531 – Business Law University of Phoenix February 23, 2011 Scenario One In this scenario New Corp is liable for wrongful termination. Unfair treatment was being displayed when pat was terminated. There had been no discussion between Pat and New Corp informing him that his job was in jeopardy or that he needed to improve his performance in any areas. Pat signed an agreement when hired for New Corp which stated that if his job performance became an issue he would be reprimanded and put on a corrective action plan to hopefully increase his productivity. There is no precise wrongful termination law but Pat’s situation is considered part of the discrimination law. Since voicing his opinion in a board meeting that was thought to be unpopular Pat feels like he has been discriminated against and treated unfairly by New Corp management. Also the contract that Pat signed has been breached because he never received notice that there was a problem with his performance. Instead he only received notice that he would be discharged which is in violation of the contract signed. New Corp will start working on these legal issues to make sure this situation doesn’t come up again. Scenario Two In the case with Sam New Corp is liable for a sexual harassment. In a situation where time is of the essence to organize, develop the strategy, meet the deadline and accomplish the goal with good results, the formal communication channel should be used to communicate to the team with a combination of oral, face to face along written communication. Because this is your first week as vice president (VP) of finance at Apex, several members of the top management team have stopped by your office. Timothy Russell, chair of the audit committee, comes in first to talk with you about the Sarbanes-Oxley Act of 2002 (SOX). “Welcome to Apex,” he says. I hope you’re getting comfortable with us here. We have a lot on our plate, and we need your assistance with some important compliance issues.” “Thanks, Tim,” you say. “Mary Francis mentioned Sarbanes-Oxley when I talked with her last week. Maybe we can start with that.” “Right. As you know, our company is private and will eventually need to seek external funding. Currently, we're not compliant with all of the requirements of SOX. Apex is compliant with Section 404 regarding internal control, but not 302 relating to the certification of the chief executive officer (CEO) and chief financial officer (CFO)." He continues, "As you know, compliance is necessary for an initial public offering (IPO) of equity shares. If John and Mary aren't confident that the internal control is sound, then they need to take steps now to change procedures.” “So, let's discuss the requirements and considerations for the CEO and CFO to achieve compliance with Section 302 of SOX,” you say.  “Exactly,” he responds...

The company, headed by CEO John Matthews, generates $450 million in revenues from three product lines (periodicals, inserts, and advertising) and has long-term contracts with several large U.S. retailers to produce weekly sales flyer inserts as well as metropolitan newspapers to produce Sunday magazine inserts and coupons. The company’s executive team, employees, and above all, its Vice President (VP) of Production, Luke Stewart, are committed to environmentally sustainable manufacturing practices. Presently, the only substrate Apex uses is paper, specifically newsprint of various weights. Trim and waste are recycled in accordance with the company’s sustainability commitment. Scenario Two

...Scenario #1: You are a manager of a company that has recently purchased a smaller company. The purchased company has an existing product, which will now be part of your product offering. The product is a weight-loss supplement called Weight Loss Optimizer. The product has been very successful for the previous owner, but the company had limited ability to adjust its manufacturing system to accommodate growth, as well as a limited potential sales audience. Your role is to oversee and coordinate all aspects of launching the product from the newly acquired company. You have a far greater manufacturing capacity and more potential customers readily available because you already sell several weight-loss related products to a large base of customers. Weight Loss Optimizer has been proven successful by a research study. The study consisted of 100 participants, 90% of whom lost at least 15 pounds over a reasonable time period. To date, the study participants have successfully maintained their weight loss by continuing to use the product. Of the users, 80% were able to maintain their weight loss with continued use of Weight Loss Optimizer. The 10% of study participants who were not successful may have been unsuccessful because they did not follow the program’s protocol as set forth. An inherent risk in a weight loss product is the inability to determine if the product has failed to produce results or if the user has not followed directions. Dissatisfied customers present a challenge......

Geert Wilders Moet Vrijgesproken Worden

...BUSN105: Scenario You are an inventor who enjoys working around the home, cleaning, cooking, and doing minor home repairs and remodeling. You have little financial skills and no management skills. You have a great idea for a new kind of home appliance that meets everyday consumer needs. Your net worth is not very high so you have no idea if you’ll be able to “fund” this start-up. You know that currently there are similar products that meet the consumers’ needs, but those products are inherently dangerous. You know nothing about manufacturing other than that it costs lots of money to set up a plant. You are convinced that this new technology idea would be applicable in a wide range of other products. Your spouse, knowing how much time this venture will take away from family time, has asked you for an example of what you mean to make sure your idea isn’t some harebrained scheme. You mention the following as two similar ideas that were developed for one application but proved to have VERY widespread applications: a. The “clicker” was initially invented for use with TV’s, but now has widespread applications for a host of electronic applications, just like your technology could potentially do. b. The 3-prong power cord for electrical appliances was invented for higher quality appliances. Lower quality appliances have a 2-prong cord, which is a safety issue. Better quality power cords have the 3rd “ground” wire, so now it has widespread application, just like your technology could...

...Communication Channel Scenarios Scenario 1 The communication channel that best suits this situation is a team meeting. This is the best choice because as the marketing manager, information can be relayed in a timely fashion and a quick response from the teammates can be received. With the deadline being a week away, it is vital that quick feedback is delivered. Being that the content is rich in information, the face-to-face communication helps to reduce any misunderstanding. If this issue were to arise, it can be resolved immediately. While relaying the strategy plan to the Vice President, a face to face conversation is also necessary. By implementing this communication channel, information can be presented with minimal time and with rapid feedback, additional changes can be made promptly. Scenario 2 To contact the IT department, a phone conversation would be the appropriate form of communication. The reason for this communication is because it is an issue that has a high demand to be resolved quickly. To inform employees, an email with the new login name and password would be sent immediately. Written communication is the best choice for this routine message because it is concrete and can be easily accessed at a later date if needed. Scenario 3 If faced with the issue of reducing the number of employees in order to stay productive, the proper communication to inform workers of the decision is a one-on-one meeting with each employee. Being that the message has......

Scenario

...SCENARIO PLANNING Scenario planning, also called scenario thinking or scenario analysis, is a strategic planning method that some organizations use to make flexible long-term plans. It is in large part an adaptation and generalization of classic methods used by military intelligence. The original method was that a group of analysts would generate simulation games for policy makers. The games combine known facts about the future, such as demographics, geography, military, political, industrial information, and mineral reserves, with plausible alternative social, technical, economic, environmental, educational, political and aesthetic (STEEEPA) trends which are key driving forces. In business applications, the emphasis on gaming the behavior of opponents was reduced (shifting more toward a game against nature). At Royal Dutch/Shell for example, scenario planning was viewed as changing mindsets about the exogenous part of the world, prior to formulating specific strategies. Scenario planning may involve aspects of Systems thinking, specifically the recognition that many factors may combine in complex ways to create sometime surprising futures (due to non-linear feedback loops). The method also allows the inclusion of factors that are difficult to formalize, such as novel insights about the future, deep shifts in values, unprecedented regulations or inventions. Systems thinking used in conjunction with scenario planning leads to plausible scenario story lines because the......
