...Name: HUY HUYNH Class: PHIL-370 Instructor: Michael Davis Third Paper ENGINEERS AND LAYERS Ornella Muti, P.E., was retained by plaintiff’s attorney to evaluate a transponder used in small planes to determine whether it could have been the cause of a mid-air collision. While doing the evaluation, Muti discovered that the transponder has a flaw which, though unrelated to the collision, might well cause another dangerous error, failure to respond during the approach to landing if the ambient temperature is too high. Since this second flaw both concerns public safety and was unrelated to the case, Muti sent a senior engineer at the defendant company a copy of the relevant parts of her report when she sent the entire report to the plaintiff’s attorney, telling the attorney what she had done. Plaintiff’s attorney then filed a complaint with us, alleging breach of confidentiality, breach of contract, and other unprofessional conduct. The case is pretty simple to understand. Muti was hired by a plaintiff’s attorney to investigate a transponder whether it caused a mid-air collision. While doing so, she found an unrelated flaw that could cause a hazard. She sent a second engineer at the defendant company parts of her report, and then sent a full report to the plaintiff’s attorney, telling about the second engineer. The attorney filed a complaint against Muti. The case itself has a few ambiguous details. We have made the following assumptions to clarify these ambiguities so that......

...than they were in their home market. The bikes are also part of US folklore. Despite what flag-waving Harley guys in bars may mistakenly claim, Steve McQueen in The Great Escape CASE STUDY IV.4 TRIUMPH MOTORCYCLES LTD 649 and Marlon Brando in The Wild One rode Triumphs. James Dean had one too. Legend and myth and the power of branding do not come any better. Bloor’s first act as a prospective motorcycle manufacturer was to hire three employees of the original Triumph company who had been involved in developing new models. Bloor realized that the engine is everything in a motorcycle, and there is no way to make a bike with a dull motor feel red-hot to the customer. So while he outsourced other parts of the bike, he put his team of engineers and metalworkers to work designing new liquid-cooled, three- and four-cylinder engines that would save costs by sharing internal parts. Bloor’s decision to keep a three-cylinder engine from the original line-up turned out to be a great marketing move, and it has helped the company stand out from the crowd. Most other bikes use two- or four-cylinder engines. Triumph’s soulful three-cylinder has won a place in the hearts of many bikers, who tend to be a discriminating bunch when it comes to how an engine feels and delivers power on the road. Three-cylinder engines are also perfect for middle-aged men who are getting back into bikes. are sold each year. Triumph currently accounts for around 2 per cent of that, compared with 12 per......

...we might also want to vary the paths to shake out more bugs.) •Learning to perform magic and learning to figure out magic tricks require us to develop observational skills, and to recognize things that deceive us. Most non-magicians fail to consider possibilities that come easily to magicians; devices, coins, or cards can be gimmicked. Non-magicians only think about normal cards. You need to think outside of the box to be a magician or to figure out how the magician does his work. This kind of reasoning and deduction are key assets to being a tester. There isn’t really such a thing as magic but there clearly is such a thing as deception. As the magician becomes more experienced and more wise to the practice, he should be able to reverse-engineer tricks by using patterns that he already knows about magic. Once you’ve seen one kind of trick, similar tricks aren’t so mysterious because you have heuristics that you can use to recognize how it’s done. TQM is the integration of all functions and processes within an organization in order to achieve continuous improvement of the quality of goods and services. The goal is customer satisfaction. “ No doubt , humans are always deficient” (Al-Quran) The Three Quality Gurus Deming: the best known of the “early” pioneers, is credited with popularizing quality control in Japan in early 1950s.Today, he is regarded as a national hero in that country and is the father of the world famous Deming prize for quality. JURAN Juran, like Deming was invited to Japan in 1954 by the union of Japanese Scientists and engineers. Juran defines quality as fitness for use in terms of design, conformance, availability, safety and field use. He focuses on top-down management and technical methods rather than worker pride and satisfaction. Philip Crosby: author of popular book Quality is Free. ...and advertising are underwritten, district offices are opened, and customer support is strengthened. Halfway through the year, however, sales revenues are disappointing. A few more companies have come on board, but only after a prolonged sales struggle and significant compromise on price. The numbers of sales overall is far fewer than expected, and growth in expenses is vastly outdistancing growth in income. In the meantime, R&D is badly bogged down with several special projects committed to in the early contracts with the original customers. Meetings are held. The salespeople complain that there are great holes in the product line and that what is available today is overpriced, full of bugs, and not what the customer wants. The engineers claim they have met spec and schedule for every major release, at which point the customer support staff merely groan. Executive managers lament that the sales force doesn’t call high enough in the prospect organization, lacks the ability to communicate the vision, and simply isn’t aggressive enough. Nothing is resolved, and, off line, political enclaves begin to form. 9 Third quarter revenues results are in—and they are absolutely dismal. It is time to whip the slaves. The board and the venture capitalist start in on the founders and the president, who in turn put the screws to the vice president of sales, who passes it on to the troops in the trenches. Turnover follows. The vice-president of marketing is fired. It’s......

...straightforward: “What’s the revenue potential of this business five years from now?” “I’m estimating eight million to ten million dollars by the end of year five,” she says. “That’s chump change to us,” he laughs. “Talk to me again when you have something with a revenue potential of a hundred million or more. Anything less is too small for us.” The VP isn’t necessarily being arrogant or short-sighted; huge corporations are handicapped in dealing with what are, to them, small business opportunities. Their human and physical assets are configured to address large markets. Thus, many worthy projects are rejected. These discarded opportunities, however, may be gold mines for small, entrepreneurial businesses. In fact, many managers and engineers leave their companies to exploit projects that their employers have rejected as too small. Ironically, the big, inflexible corporations that will not pursue small, entrepreneurial ventures often end up writing huge checks to acquire these same ventures after they are successful and have grown substantially. The case of Snapple is instructive. Snapple was an entrepreneurial firm that developed a very successful ice-tea and fruitdrink business. And it was growing fast. Between 1991 and 1994, its revenues skyrocketed from $95 million to $516 million. Instead of starting its own ice-tea and fruit-drink enterprise, U.S. food giant Quaker, a unit of PepsiCo, acquired Snapple in 1994 for $1.7 billion. 14 Entrepreneur’s......
