Abstract

This paper will review the importance of roles and responsibilities of contracting officers and administrator. It will look at the importance of improving the methods of creating contract schedules. This paper will develop a policy to explain the roles the contracting officers should have played with regards to GAO-09-406T, Department of Energy: Contract and Project Management Concerns at National Nuclear Security Administration and Office of Environmental Management. It will also recommend how each agency listed in the GAO-09-406T testimony could improve its effectiveness in the areas of contract administration and project management.

What are the significant roles and responsibilities of contracting officers and administrator? Only Contracting Officers (CO’s) have the authority to legally bind the government and to enter into, administer, and terminate (if necessary) contracts for the Government. CO’s have the overall and primary responsibility ensuring performance of all necessary actions for effective contracting, ensuring compliance with the terms of the contract, and safeguarding the interests of the United States in its contractual relationships. Effective administration includes modifying and deviating from the contract terms, conditions, requirement, specifications, and delivery schedules; making the final decisions involving such matters as: invoice payments or other consideration due to the Government for nonperformance or unsatisfactory performance, interpreting the contract, and resolving disputes (Engelbeck 2002). The specific nature and extent of contract administration varies from contract to contract. It can range from the minimum acceptance of a delivery and…...

Contract Administration Plan

...4 “A contract administration plan helps your business manage a contract successfully and provides a tool for monitoring your company’s performance and adherence to the contract terms,” (Luther, 2012, P. 1). For a contract to be successful, management must read contracts thoroughly and understand the consequences if the terms and conditions are not met and followed. A contract administration plan “establishes systems and processes to ensure that the contractor complies with the terms and conditions during performance of the contract,” (Department of Treasury and Finance, 2001). Most businesses at some point have to sign a contract or several, whether it is for office space or for goods and services. The organization one classmate works for does subscribe to contract administration plans. An example is the facility going through an expansion. The company is building a new critical care unit as well as a new emergency room unit. This adds an additional 200 rooms to the already 250 rooms that exist. Finalization of the contract occurred at the end of last year after four years of bidding and negotiations. The ground-breaking ceremony for the new project happened at the beginning of the year, and completion should occur early 2014. A contract is a legally enforceable agreement between two or more people. Contract administration involves those surveillance activities performed by an enterprise's administrative personnel charged with ensuring the performance of the contract......

Contract Administration Plans

...development of a contract administration plan affect a company’s business? The development of a contract administration plan affects a company’s business by giving its employees a basic guideline and creates a standard in specific areas. Contracts can also benefit businesses in assisting them with the assurance that they are following specific legal responsibilities in the case of regulatory compliance. A contract is usually very specific and prescribes individuals with a tool to conduct business to ensure a minimal amount of conflict with other partners within the business or with outside sources that are involved with the business. Contracts can also give specific guidelines when it comes to ADR. In the event of a conflict, ADR alternatives can be agreed upon by both parties and detailed in the contract. Contracts keep both parties best interests in mind when dealing with profit, conflict, and any other uncompromising situations that may arise. The contract also often spells out exactly who will be responsible for fees if litigation or an ADR are needed. A contract administration plan is a road map to ensure that all involving parties receive all that they bargained for from outside contractors. Developing a quality contract administration plan is essential for a good contract administration. Health Literacy can be used by social media as a means of helping people understand a topic that they may not quite understand. This can also be beneficial in small towns where there may be limited or no health care for individuals. “Health Care providers need to recognize consumers use social media as a source of information on providers. Busi561 Legal Issues in Business - Contracts

...Discussion Board Forum 2: Contracts BUSI561 – Legal Issues in Business November 10, 2013 Analysis of the Situation Let me begin by assessing the current situation and relationship with Don. Don and I met because of our individual desires to walk with Christ. We developed our friendship that eventually evolved to a business relationship; we are both small business owners. Our business venture started under favorable circumstances consistent with implied duty of faith and fair dealings. According to Kubasek, Brennan, &Browne (2012), an implied contract is formed by conduct of involved parties rather than written or spoken words. That was exactly the case between us. Don would place routine orders and would generally pay all invoices due within 45-60 days. I continue to supply him with my product [Scuppernong grapes] at consistent prices. The situation appeared to be mutually beneficial. Just recently, my product started to gain popularity that resulted to increased demand far in excess of my ability to supply. A company in Connecticut presented an extremely advantageous offer. After contacting Don to inform him of the circumstances, I was informed that my 17-year-old son who is a part-time deliveryman signed a requirements contract on behalf of my company. Neither my son nor Don had mentioned the existence of the contract before. Identifying Present Issues Based on recent developments, my company is facing several pressing issues. I have one current......

E-Contracts Issues

...Topic: Electronic Contracts – Issues and Challenges Electronic Contracts – Issues and Challenges Introduction: Electronic contracts (e-contracts) are governed by the basic principles provided in the Indian Contract Act, 1872 applicable to regular contracts, which mandates that a valid contract should have been entered with a free consent and for a lawful consideration between two adults. Electronic contracts are not paper based but rather in electronic form and are born out of the need for speed of execution, convenience and efficiency. Due to growing competition, organizations are focusing more on their core business activities and moving towards outsourcing of other activities and services. This business model necessitates companies to work with different vendors and partners by mutually arriving at contractual agreements in order to identify roles, responsibilities, obligations and deliverables of specific organizations and individuals. Typically, a legal contract forms the basis to regulate interactions between different parties in businesses and governs legal aspects when there is a breach of contract. The Indian Contract Act, 1872 governs the manner in which contracts are developed and executed in India. The Act governs the method in which the provisions in a contract are implemented and classifies the effect of a breach of contractual provisions. Within the framework of the Act, parties are free to choose the terms of the contract. The Act itself consists of......

Give an example of each. a. Full and open competition; Full and open competition means that all responsible sources are permitted to submit sealed bids or competitive proposals on the procurement. Contenta with the underlying norms and values of “Indian education” highlighted in the video the Mission school syndrome and in the readings by Titley, Levaque, Gresko and Wilson. (750-1000 word) Although education was meant for all children, education for Aboriginal children clearly had a hidden curriculum. It has been mentioned in all of the readings and the movie that the main objective was to civilize them into the White culture which included the teaching of the English Language (reading, writing and speaking), religion, agriculture and other trade skills necessary to live in a “White’s man world”, where “the primary motive was to spread the Gospel of Jesus Christ.”[1] However, the interpretation of the events of those days differs in perspective between the religious groups and the Native people. As Europeans immigrated to Canada and settled on the lands where Aboriginals hunted and lived, themselves hunting the same animals as the Natives (for sport rather than survival) and restricting the territory forcing Aboriginals onto reserves or residential schools. The Whites did not understand this way of life even thinking...

The Development of a Contract Administration Plan Affect a Company’s Business

...a lot to be considered when choosing the right form of business. An entrepreneur would need to carefully research, diagnose, and understand all of the different dynamics of each business to select the right form successfully. Gathering the data of the situation, understanding the strengths of what you have to work with, and who you trust is “key” as well. The financial and legal documentation is a really important portion to consider. All segments considered and deliberated should primarily lead ambitious entrepreneurs in the direction to be prepared to make the most responsible choice for success. Reference: Cheeseman, H.R.
